Jonathan Martin Will Go To Trial Over Threatening Instagram Story

A judge ruled the posts warranted a trial.

Ex-NFL player Jonathan Martin, who played for the Miami Dolphins and was known for the bullying he was subjected to at the hands of Richie Incognito, will have to stand trial for the threatening Instagram story he posted back on February 22nd. The post featured a shotgun with shells on a bed and tagged four people, including Incognito and Mike Pouncey. 

"When you’re a bully victim & a coward, your options are suicide or revenge," Martin wrote in the post. He also tagged his former school Harvard-Westlake which ended up shutting down for the day.

After looking at the post, the judge made a ruling on whether or not it was worth a trial.

"It does say suicide or revenge," the judge explained, according to the New York Daily News. "That does sound equivocal on its face. However, on the photo, there are 19 shells. Suicide would take one shot. Nineteen shells is a mass shooting, killing more than one person, revenge. I think that's unequivocal enough [under the law] to be a criminal threat."

Martin eventually joined the San Francisco 49ers after his tumultuous time in Miami and his last game was played in 2014.

It is reported that Martin will appear in court on January 30th.
