In late 2014 Kesha tried to get out of her contract with Sony and Dr. Luke after filing documents that the famed producer sexually assaulted her among other things. Months later her case was dismissed and she was still forced to adhere to her written contract. She's now set to go on tour this summer - after releasing Rainbow last year - and although she doesn't want Luke to profit from her work, he may have to since just recently a judge has once again rejected her case.
According to The Hollywood Reporter, Luke is countersuing Kesha for smearing his reputation as she still continues to try and get dropped from the contract. "You can get a divorce from an abusive spouse. You can dissolve a partnership if the relationship becomes irreconcilable. The same opportunity — to be liberated from the physical, emotional, and financial bondage of a destructive relationship — should be available to a recording artist," her suit reads.
In March 2017, New York Supreme Court Justice Shirley Kornreich agreed with Luke's attorney saying Kesha should have provided notice of a contract breach and her attempts of trying to work with other producers and her allegations of the impossibility of performance are just based on speculation.
"Kesha's proposed amendments are palpably insufficient and devoid of merit," New York's First Department stated today. "Her counterclaim seeking declaratory relief terminating the agreements on the ground of impossibility and impracticability of performance was speculative, contradicted by her own allegations that she had continued performing under the agreements and, as to at least one of the agreements, the impossibility was not produced by an unanticipated event that could not have been foreseen or guarded against."
Kesha seemingly has a ways to go to get justice. Check out what The Game said on the matter two years ago.
